Terms & Conditions
V.M.S accepts instructions only upon the terms and conditions set out below. No servant or agent of VMS is permitted to vary these terms and conditions unless expressly authorised in writing to do so. However any servant or agent shall have the full benefit of these terms and conditions.
These terms and conditions govern the provision of all and any services provided by VMS in respect of but not limited to the processing of visas, passports and/or documents for their clients and all orders placed by their clients are made and accepted subject to the terms hereinafter set out.
VMS will use its best endeavours to process applications for visas, passports and/or documents at the client’s request. However, VMS shall not be held responsible for nor accept any liability for the actions of any consulate, embassy, or passport office in delaying or not issuing such applications for any reason whatsoever, nor shall VMS be held responsible for expense and/or delay arising from or in connection with: (a) incomplete application forms or (b) incorrectly or falsely completed application forms or (c) inaccurate or incomplete supporting documentation. Any expense or cost incurred by the client due to these delays or non-issuances shall not be the responsibility of, nor shall any charges be levied upon, VMS. Tickets for travel should not be purchased prior to the visa/passport being issued unless they are a specific requirement for that consulate and in such cases open tickets should be obtained.
VMS provides carefully compiled visa and passport information in good faith on the express understanding that the said information is the interpretation of any or all information provided by respective embassies, consulates or passport offices at any or all times and VMS shall not accept responsibility or liability whatsoever for any errors and/or omissions in the information.
VMS will endeavour, wherever possible, to process the client’s visa, passport and/or document based on the instructions given and application forms submitted, although it is the client’s express responsibility to ensure that the validity of the said visa/passport/document obtained includes and covers the periods of time in which the client plans to enter and leave the country or countries that the client is visiting and for the number of entries to that country and is valid for the purpose intended.
Should a passport, document or other item be lost, misplaced, damaged, delayed or destroyed by any means whatsoever, VMS shall only be responsible for the basic replacement cost of said item should the fault rest with them. VMS is not responsible for items misplaced, damaged, delayed or destroyed by a consulate, embassy or passport office.
The fee which shall be payable by the client in respect of services provided by VMS is exclusive of any consular or embassy charges whatsoever. Such consular or embassy charges as may be made will be the absolute liability of the client who must make payment in respect of those charges. VMS reserves the right to raise its charges at any time with or without prior notice.
Consular fees and availability of services are subject to change without notice. Fees and services may differ between the time the order is placed and when the ordered is completed. VMS will endeavour to communicate said changes to the client where possible. VMS reserves the right to select the most appropriate service available given the time constraints as indicated by the client.
VMS will send completed applications by Royal Mail Special Delivery unless otherwise instructed. A delivery charge will be added to your order. Royal Mail Special Delivery, Same day couriers, UK Overnight Couriers, International Courier services and other third party delivery companies are subject to the conditions set by these individual companies. VMS accepts no liability for loss or delays incurred when using third party delivery companies.
Payment of VMS fee is due together with any anticipated consular or embassy charges upon VMS being instructed unless account facilities have been agreed in writing prior to the said instructions.
Unless instructions are made in writing VMS shall not be held responsible for taking such steps as are reasonably considered as fulfilling the implied instructions of the client and/or as being in the best interest of the client and any charges for such services rendered shall be wholly the responsibility of the client.
Where VMS receives any personal data, as defined by the Data Protection Act 1998, from the client it shall ensure it fully complies with the provisions of the Act and only deals with the data to fulfil its obligations under the contract. VMS shall indemnify the client for any breach of the Act which renders the latter liable for any costs, claims or expenses. VMS shall allow its staff reasonable access to the information as is necessary to ensure completion of the contract.
VMS reserves the right to retain all passports and documents until payment of the aforementioned amounts is received in full.
VMS reserves the right to refuse in its total discretion to handle any application or carry any item at any time and no reason need be given.
These terms and condition shall be governed by and construed in accordance with the laws of England.
